Terms of Service

1. Acceptance of Terms

By accessing or using the Ciphrai Security platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Ciphrai Security provides a cloud-based cybersecurity platform that includes:

• Email Protection: AI-powered scanning of emails connected via OAuth (Gmail, Microsoft 365) for phishing, malware, and other threats
• Network Security: Web Application Firewall (WAF), intrusion detection, and bot protection for connected websites
• Vulnerability Scanning: Automated security assessments of websites and infrastructure (Professional plan only)
• Dashboard & Reporting: Centralized threat monitoring, audit logs, and security analytics

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service.

3.2 Account Security

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access to your account

3.3 Password Requirements

Passwords must contain at least 8 characters, including an uppercase letter, a lowercase letter, a number, and a special character.

4. Free Trial

• Eligible new accounts receive a 30-day free trial with full access to all features
• Free trials are strictly limited to one (1) per user / organization. Deleting an account and re-registering with the same email address will not grant an additional free trial
• Accounts created after a trial has previously been claimed will require an active paid subscription to enable security monitoring
• No credit card is required to start a trial
• At the end of the trial, access to protected features will be restricted until a subscription is activated
• We will send email reminders before your trial expires

5. Subscription and Payments

5.1 Plans

We offer two subscription tiers:

• Essential ($99/month): Email protection, network security, dashboard, and audit logs
• Professional ($149/month): Everything in Essential plus vulnerability scanning, CVE database integration, and priority support

5.2 Billing

• Subscriptions are billed monthly through Paystack
• Prices are listed in USD and converted to your local currency at the current exchange rate at the time of payment
• All payments are non-refundable unless required by applicable law

5.3 Cancellation

• You may cancel your subscription at any time from your dashboard
• Upon cancellation, you will retain access until the end of your current billing period
• No further charges will be applied after cancellation

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to other users' accounts or our systems
• Use the Service to conduct offensive security operations (e.g., attacking third-party systems)
• Reverse-engineer, decompile, or disassemble any part of the Service
• Resell, redistribute, or sublicense access to the Service without written consent
• Deliberately overload or disrupt the Service's infrastructure
• Use the vulnerability scanner to scan domains or systems you do not own or have authorization to test

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described therein.

8. Intellectual Property

• The Service, including all software, designs, content, and trademarks, is owned by Ciphrai Security
• Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service
• You retain ownership of all data you provide to or generate through the Service

9. Service Availability

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted availability
• We may perform scheduled maintenance with reasonable advance notice
• We are not responsible for downtime caused by factors outside our control (internet outages, third-party service failures, force majeure events)

10. Limitation of Liability

To the maximum extent permitted by law:

• Ciphrai Security is provided "as is" and "as available" without warranties of any kind
• We do not warrant that the Service will detect all security threats
• Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim
• We are not liable for indirect, incidental, consequential, or punitive damages

11. Indemnification

You agree to indemnify and hold harmless Ciphrai Security from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

• By You: You may close your account at any time by contacting us at ciphrai.sec@gmail.com
• By Us: We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity
• Upon termination, your right to access the Service ceases immediately
• We will retain your data for 30 days post-termination to allow for data export requests, after which it will be permanently deleted

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa, unless otherwise required by the laws of your jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
